Terms of Service

Welcome, Breaker. These Terms cover your use of everything Elemental Fracture (“we,” “us,” “our”) runs: our game servers, the launcher, our account system, our Discord community and its bot (“Marla”), the modding toolkit, and our website. Elemental Fracture is a non-commercial, volunteer-run preservation community for Spellbreak®. By using any of it, you agree to these Terms, our Privacy Policy, and our Legal Status & Fair Use page. If you don’t agree, please don’t use the Services.

We’ve kept this plain on purpose. It’s mostly common sense.

1. Who can use this

• You must be at least 13 years old (or older where your local law or Discord requires). If you’re under the age of majority where you live, you should have a parent or guardian’s okay.
• Access is a privilege extended by a volunteer community, not a right. We may change, pause, or shut down any part of the Services at any time.

2. Your account

• Accounts are created with a username, email, and password (verified by a one-time email code), from the website or the launcher, with optional Discord linking. Members who prefer Discord can also register through our bot, “Marla,” with /register.
• Keep your credentials secret. Your password is your key. Don’t share it or paste it anywhere except the official launcher or game. If it leaks, change your password right away, and reset it if you’re locked out.
• You’re responsible for what happens on your account.
• One person, one identity. Don’t make extra accounts to dodge moderation, impersonate people, or inflate stats.

3. Community Guidelines

Elemental Fracture exists because people love this game and want a welcoming place to play it. These apply everywhere the community gathers: in-game, in the launcher, and in Discord.

Be a decent person

• Treat others with respect. No harassment, hate speech, slurs, threats, stalking, or targeted abuse. Discrimination based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, disability, age, or any similar trait is not tolerated.
• No sexual content involving minors, ever. Anything sexualizing anyone under 18, real or fictional, means an immediate permanent ban and, where required, a report to the authorities.
• Nothing illegal, and nothing that incites violence, promotes self-harm, or glorifies terrorism or hate.
• Heated match banter is fine; bullying and cruelty are not.

Play fair

• No cheating: no aimbots, wallhacks, ESP, injected exploits (other than our own sanctioned mods), or memory editing for advantage.
• No exploiting bugs for an unfair edge or to disrupt matches. Report serious exploits to staff instead of abusing them.
• No griefing, match sabotage, or unauthorized botting of gameplay, queues, or community systems.
• Our servers run on donated time and money. Be considerate of other players and of the servers.

Respect the community and the mission

• No impersonation of staff, other members, Proletariat, Blizzard, or anyone else.
• No spam, scams, phishing, or advertising. Never try to trick anyone into handing over a token, password, or code. Ignore and report suspicious DMs.
• Pick a legible, appropriate name. No offensive, impersonating, or disruptive names.
• Don’t use our mods, tools, or accounts against official/live servers of any game. They’re for the Elemental Fracture preservation servers only.
• Don’t try to monetize the game, our servers, or access to them. This project is free and stays free.
• Don’t attack our infrastructure or other people’s accounts (no DoS, unauthorized probing, credential theft, or ban evasion), and don’t misrepresent the project as official.

4. Mods and tools

Use our sanctioned mods as intended. You may study and build on our own original software under whatever license we publish for it. Don’t distribute cheats, malware, or mods designed to harm players, compromise accounts, or attack the Services. Reverse engineering for interoperability and preservation is part of what this project is; see Legal Status.

5. Donations

Donations (for example, via Patreon) are voluntary gifts that help cover the project’s real costs: website, game servers, and CDN. They don’t buy the game, in-game advantages, guaranteed access, or any stake in the project. Any role or recognition that comes with a donation is a thank-you, not a purchase, and since donations are usually spent immediately on hosting, they’re generally non-refundable.

6. Moderation

Staff may warn, mute, restrict, kick, or ban any account and remove content to enforce these Terms and keep the community safe. We act at our discretion, and serious violations (cheating, harassment, illegal content, attacks on infrastructure) can mean an immediate permanent ban. Where needed to stop ban evasion, enforcement can attach to your account and to network or device identifiers linked to it.

If you think we got it wrong, appeal: contact staff in Discord or email [email protected]. We try to be fair and to talk things through. You can also stop using the Services and request deletion of your account at any time (see the Privacy Policy).

7. The honest disclaimer

This is a free, volunteer preservation project provided “as is.” We can’t promise the Services will always be online, secure, or free of bugs or data loss: servers go down, things break, and features change or disappear. Use the Services at your own risk. To the extent the law allows, we and our volunteers aren’t liable for losses arising from your use of (or inability to use) the Services, or from anything you do through them. Nothing here limits rights you have under the mandatory laws where you live.

8. Copyright complaints (DMCA)

If you believe material we host infringes your copyright, email [email protected] with enough detail to identify the work and where it appears, your contact information, and a good-faith statement. We respond in good faith and will remove or disable infringing material where appropriate. See Legal Status & Fair Use for our broader position and for rights-holder inquiries.

9. Changes and contact

We may update these Terms as the project evolves; we’ll update the date above and announce material changes through our usual channels. Continuing to use the Services means you accept the current version.
